The waiver and liability terms
Welcome to activities, exchange programs, courses, performances, competitions, cultural experiences, and related projects organized, coordinated, co-organized, or arranged by INFINITY FLY LIMITED (hereinafter referred to as the “Company” or the “Organizer”) (collectively referred to as the “Activities”).
To ensure the safety of all participants and the smooth operation of the Activities, participants and parents/guardians are requested to carefully read the following terms and conditions before registration. By submitting an application, making payment, or participating in any Activity, you acknowledge that you have read, understood, and agreed to the following terms.
1. Nature of the Activities
The Activities organized by the Company may include, but are not limited to:

Music, arts, and cultural exchange activities

Courses, workshops, and training programs
-
Competitions, performances, and public events
-
Overseas exchange and educational programs
-
Japanese cultural and experiential activities
-
Outdoor, group, or team activities
-
Educational, business, and cultural exchange projects
-
Activities jointly organized with partner organizations
Activity content, schedules, venues, and arrangements may be adjusted according to actual circumstances.
2. Participant Responsibilities
Participants and parents/guardians acknowledge and agree that:

The participant is physically and mentally fit to participate in the relevant Activities;
-
Any illness, allergies, medical conditions, psychological conditions, or special requirements must be disclosed to the Organizer prior to registration;
-
Participants must follow the instructions and arrangements of the Organizer, instructors, leaders, staff members, and partner organizations;
-
Participants must comply with the laws, regulations, and safety requirements of Hong Kong and the location where the Activities are held;
-
Participants are responsible for safeguarding their personal belongings, identification documents, money, and valuables.
Any loss, injury, accident, or third-party claim resulting from a participant’s negligence, misconduct, violation of rules, or failure to follow instructions shall be the sole responsibility of the participant.
3. Health, Medical & Insurance
Participants and parents/guardians understand and agree that:

The Organizer strongly recommends that all participants obtain appropriate medical insurance, overseas activity coverage, and personal accident insurance;

Participants are responsible for their own medical expenses and related costs;
-
In the event of illness, injury, accident, or emergency during the Activities, the Organizer reserves the right to:
-
Contact parents/guardians;
-
Arrange basic emergency assistance;
-
Arrange hospital transfer or medical treatment if necessary.
Any medical expenses or related costs arising therefrom shall generally be borne by the participant and/or their parent/guardian.
4. Personal Belongings & Musical Instruments
Participants are solely responsible for the safekeeping, transportation, and insurance arrangements of their:

Personal belongings
-
Musical instruments
-
Luggage
-
Identification documents
-
Electronic devices
-
Valuables
The Organizer shall not be liable for any loss, damage, delay, theft, or third-party-related incidents involving such items.
5. Activity Changes, Postponement & Cancellation
The Organizer reserves the right to adjust, modify, postpone, or cancel any Activity due to:

Weather conditions
-
Natural disasters
-
Pandemics or government restrictions
-
Transportation or venue issues
-
Safety concerns
-
Arrangements with partner organizations
-
Insufficient participant numbers
-
Force majeure events
-
Any other circumstances deemed appropriate by the Organizer
The Organizer will make reasonable efforts to provide appropriate arrangements but does not guarantee that changes or losses can be completely avoided.
6. Waiver & Limitation of Liability
The Organizer, partner organizations, instructors, leaders, staff members, and affiliated parties will make reasonable efforts to ensure the safety and smooth operation of the Activities.
However, the Organizer shall not be held legally liable for any loss, injury, delay, cancellation, property damage, or other incidents arising from:

Natural disasters or severe weather

Transportation or third-party service issues
-
Pandemics or government policies
-
Personal illness, accidents, or unforeseen circumstances
-
Participant negligence, misconduct, or rule violations
-
Actions of third parties
-
Force majeure events
Participants and parents/guardians agree not to pursue legal action, claims, compensation, or litigation against the Organizer arising from the above circumstances.
7. Photography, Video & Media Usage
Photographs, videos, audio recordings, and performance recordings taken during the Activities may be used for:

Official websites
-
Social media platforms
-
Promotional materials
-
Event documentation
-
Marketing purposes
-
Future activity promotions
If participants or parents/guardians do not consent to the public use of such materials, written notice must be provided to the Organizer prior to the Activity.
8. Parental Consent for Minors
For participants under the age of 18, parents/guardians acknowledge and agree that:

They have read and understood these terms and conditions;
-
They consent to the minor participant joining the Activities;
-
They authorize the Organizer to make reasonable arrangements in emergency situations;
-
They understand that participation in Activities may involve certain risks;
-
They agree to comply with the Organizer’s arrangements and regulations.
9. Governing Law & Jurisdiction
These terms and conditions shall be governed by and interpreted in accordance with the laws of the Hong Kong Special Administrative Region.
For Activities conducted overseas, participants must also comply with the applicable local laws and regulations.
10. Final Decision Rights
The Organizer reserves the right of final interpretation and decision regarding all Activity arrangements, content, modifications, and these terms and conditions.
